OUTSIDE TRAVEL AGENT AGREEMENT
This contract is to serve as an outside travel agent agreement between Easy Travel Agency and ______________, and is intended to outline the initial agreements between the two (2) parties, regarding commissions and procedures.
Both parties have agreed upon the following items for two (2) years from date of signatures:
1. _____________________ will be considered an outside travel agent and NOT an employee of Easy Travel Agency. Hence, _____________________ will be responsible for the withholding of all taxes to the United States Government at the end of each year, and will be supplied a 1099 within 60 days after each years end.
THERE IS A ONE-TIME SETUP CHARGE OF $199.00 (one person), and an additional $50.00 per each additional
outside agent (working from the same location). I.E. If a husband/wife team want to start their own agency, the total setup charge would be $249.00, if
there were three (3) people that would be working together as one agency, the charge would be $299.00..etc.
This charge includes, but is not limited to the following:
2. Easy Travel Agency will provide ongoing training, materials and assistance to _____________________, (i.e. sales training, brochures, polices and procedures of varies travel entities, etc.). In exchange, _____________________ will agree to be an exclusive outside travel agent, booking ALL travel activities, for
the outside agent and their clients, through this agency for a period of two years, with an option for the third (3) year.
3. For the first year, all packages made directly by _____________________, the commissions and bonuses paid by the various companies (i.e. cruise lines, land packages, etc.) will be split between the above mentioned parties as follows:
55% - Easy Travel Agency / 45% - _____________________*
*Year two (2) commissions and bonuses will be re-negotiated at the end of the first (1) years contract.
4. Easy Travel Agency has a $100.00 non-refundable deposit per person on all packages, in the event of cancellations, which is in addition to any penalties by the various companies, which is non-commissionable.
5. All client checks and money orders must be made out to _____________________; she is SOLELY responsible for the handling of all such funds. All payments for client travel can be handled in one of two (2) ways:
1. _____________________ will handle all individual checks and money orders submitted, and submit a lump sum payment to this office. (I.e. Initial deposit is $50.00 per person x 10 people = $500.00; All clients pay _____________________, she would submit a lump sum payment to Easy Travel Agency for $500.00, along with a complete rooming list showing the amount paid by each person, roommates, and rooms preferred (double, triple, Oceanview,
inside..etc).
2. Credit card payments may be accepted, (First or last payment by client, MUST be by check, cash or money order), but MUST have correct spelling of clients’ name, address, City, St, Zip, and 3 or 4-digit credit card code (located on back of all credit cards), and submitted to this office either by phone or mail.
6. All Final Payments for client travel MUST be received in this agency (10) days PRIOR TO actual final payment date. Easy Travel Agency MUST receive full and final payments on all packages/bookings before documents can be issued.
7. Commissions, cancellations and client refunds, will be paid to _____________________ on all bookings made directly by her, 30-days or greater after client travel completed, depending on turn-around from various companies.
8. _____________________ is to handle all arrangements and take full responsibility for her clients directly. This agency is here to offer assistance, and will be more than happy to answer any questions or concerns, but in no way accepts responsibility for any actions of _____________________.
9. _____________________ agrees to use the Easy Travel Agency’ name, and will act accordingly, which includes, but not limited to: handling all clients and potential clients in a friendly, professional manner, follow-up promptly on all client quotes and inquires, and distributing all clients documents and informational materials in a timely manner.
10. To obtain full benefits as
an outside agent, including the issuance and maintenance of CLIA identification
card (s), the annual minimum paid, gross bookings must be met. AFTER THE
ANNUAL QUALIFICATION AMOUNT OF $599.99 HAS BEEN REACHED, the cost for the
issuance and maintenance of the CLIA identification card (s) will be the sole
responsibility of the outside agent, and can be purchased through this agency.
11. _____________________ understands that this contract can be nullified, with a 30-day written notice, and sufficient reason, however, any bookings made by her prior to the date of contract termination, all terms of this contract must be followed through, and Easy Travel Agency is still entitled to their split of the commissions and bonuses.
The signing of this agreement indicates that both parties are in agreement to its contents. Future dates and additions can be made as deemed necessary and agreed on by both parties.
